SMS Messaging Terms

These SMS Messaging Terms govern the ACED / artsncraftaced SMS Program operated by artsncraftaced, carrying on business as ACED / artsncraftaced (“ACED,” “we,” “us,” or “our”).
By subscribing to the SMS Program, you agree to these terms, our Privacy Policy, and our general Terms of Service.
1. Program description
The SMS Program may send recurring messages concerning:

Promotions and discount codes

Exclusive subscriber offers

Restocks and low-stock alerts

Shopping-cart reminders

Order and account updates

Events, giveaways, and brand announcements

Messages may be sent using automated technology through our messaging service provider, Postscript.
2. Consent
By voluntarily entering your mobile telephone number through our website, checkout, popup, landing page, keyword, QR code, or another disclosed opt-in method, you consent to receive recurring promotional and informational text messages from ACED at the number provided.
Consent is not a condition of purchasing any product or service.
You confirm that:

You have reached the age of majority in your jurisdiction or have appropriate parental or guardian permission
We may maintain electronic records of your consent, including the date, time, source, telephone number, and applicable disclosure presented when you subscribed.
3. Message frequency
Message frequency varies depending on promotions, product launches, store activity, and your interactions with us.
You may receive multiple messages in a week during launches or promotional periods. We do not guarantee a specific number of messages.
4. Message and data rates
Message and data rates may apply according to your mobile plan and wireless carrier.
You are responsible for charges imposed by your carrier. Contact your carrier for information about your messaging and data plan.
5. How to unsubscribe
You may withdraw your consent and unsubscribe at any time by replying:

After submitting a valid opt-out request, you may receive a final message confirming that you have been unsubscribed. After that confirmation, we will not send further promotional SMS messages unless you voluntarily subscribe again.
Other commonly recognized opt-out words may also be processed where supported by our messaging platform or carrier requirements.
Unsubscribing from promotional SMS messages does not necessarily prevent essential non-promotional communications that you separately request or that are necessary to complete an active transaction, where permitted by law.

Support responses may not be immediate. Do not use the SMS Program for emergencies.
7. Changes to your telephone number
You must promptly unsubscribe before transferring, cancelling, reassigning, or otherwise giving up the telephone number used to subscribe.
You agree that failure to notify us of a number change may result in messages being delivered to a person who later receives that number.
You agree to indemnify us to the extent permitted by law for claims resulting from your failure to notify us that you no longer control the subscribed number.
8. Delivery limitations
Wireless carriers do not guarantee that text messages will always be delivered.
Message delivery may be affected by:

Network congestion

Device compatibility

Geographic restrictions

Service interruptions

Filtering or blocking

Number changes

Circumstances outside our reasonable control
Neither we nor participating carriers are liable for delayed or undelivered messages to the extent permitted by law.
9. Supported carriers and devices
The SMS Program may not be available through every carrier, device, telephone plan, or geographic location.
You are responsible for using a compatible, text-enabled mobile device and supported wireless service.
10. Privacy and mobile information
Our collection, use, retention, and disclosure of personal information connected to the SMS Program are described in our Privacy Policy.
We may collect and process:

Purchase and website activity associated with the number

Technical and compliance information
We use Postscript and related service providers to operate the SMS Program.
Mobile information will not be sold or rented. Mobile information and SMS consent will not be shared with unaffiliated third parties for their own independent marketing purposes. Information may be disclosed to service providers that help us operate, secure, analyze, and administer the SMS Program.
11. Canadian commercial electronic messages
Where Canada’s Anti-Spam Legislation applies, we will send commercial electronic messages only where we have a legally valid basis to do so.
Our messages will identify ACED or otherwise make the sender identifiable, provide access to our contact information, and include a functioning unsubscribe method as required by applicable law.
You may withdraw consent at any time using the instructions in these terms.
12. Prohibited use
You may not use the SMS Program to:

Submit a number you do not own or control

Impersonate another person

Interfere with or disrupt the messaging service

Send unlawful, abusive, fraudulent, or malicious communications

Attempt to gain unauthorized access to our systems or service providers
13. Suspension or termination
We may suspend or terminate your participation in the SMS Program if:

You violate these terms

We reasonably suspect fraud, misuse, or unauthorized activity

Your carrier blocks messages

Your number becomes invalid or inactive

We discontinue the SMS Program
Termination of the SMS Program does not affect rights or obligations that arose before termination.
14. Changes to the program or terms
We may change, suspend, or discontinue the SMS Program and may update these terms to reflect changes in our business, technology, service providers, carrier standards, or applicable law.
The revised terms will be posted on the Site with an updated effective date. We will provide additional notice or obtain additional consent where required.
15. Disclaimer and limitation of liability
The SMS Program is provided on an “as available” basis.
To the fullest extent permitted by law, we do not guarantee uninterrupted, timely, secure, or error-free delivery.
Nothing in these terms excludes or limits a legal right or liability that cannot lawfully be excluded or limited.
16. Governing law
These SMS Messaging Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
Mandatory consumer protections in your home jurisdiction continue to apply where they cannot legally be waived.
