Terms of Service

These Terms of Service (“Terms”) govern your access to and use of  artsncraftzaced.com and any products or services offered by artsncraftaced, carrying on business as ACED / artnscraftaced (“ACED,” “we,” “us,” or “our”).

By visiting the Site, placing an order, or using our services, you agree to these Terms and our Privacy Policy, Refund Policy, and Shipping Policy.

Do not use the Site or place an order if you do not agree to these Terms.

1. Online store terms

You must have reached the age of majority in your province, territory, state, or country to make a purchase through the Site. A minor may use the Site only with the involvement and permission of a parent or legal guardian.

You may not use our products or services for an unlawful or unauthorized purpose.

You must not transmit viruses, malicious code, or other material designed to disrupt, damage, or interfere with the Site or another person’s systems.

2. General conditions

We reserve the right to refuse service, cancel an order, limit quantities, suspend an account, or restrict access to the Site where reasonably necessary to address suspected fraud, misuse, legal violations, security concerns, inaccurate information, abusive conduct, or breaches of these Terms.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or our services without our prior written permission.

3. Product information

We make reasonable efforts to display product descriptions, colours, measurements, materials, photographs, and other details accurately.

Colours and appearance may vary depending on your screen, lighting conditions, manufacturing process, materials, or individual product variation. Distressed, washed, embroidered, printed, rhinestone, handmade, or custom-finished products may have minor differences between units.

Unless expressly stated otherwise, minor variations that do not materially affect the product’s function are not defects.

4. Availability and product changes

Products and sizes may be available in limited quantities and may sell out without notice.

We may:

• Add or discontinue products

• Change product designs or materials

• Correct product information

• Limit sales by person, household, geographic area, or jurisdiction

• Limit the quantity available for purchase

• Cancel suspected reseller, fraudulent, or automated orders

Nothing on the Site guarantees future availability.

5. Prices and taxes

Prices are displayed in the currency shown during checkout and may change without notice.

Applicable taxes, shipping charges, customs duties, import charges, brokerage fees, or other charges may be added where applicable.

You are responsible for customs, duties, taxes, and import charges imposed by the destination country unless we expressly state otherwise.

A price displayed in error does not obligate us to complete a transaction at that price. We may cancel the affected order and issue a refund.

6. Orders and acceptance

An order confirmation means we received your order. It does not necessarily mean the order has been accepted or shipped.

We may verify payment, billing, shipping, inventory, identity, and fraud-related information before accepting an order.

We may reject or cancel an order where:

• Payment cannot be authorized

• Information is inaccurate or incomplete

• Inventory is unavailable

• A pricing or product error occurred

• Fraud or unauthorized activity is suspected

• The order violates these Terms

• Shipping to the destination is unavailable or restricted

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method, subject to payment-provider processing times.

7. Billing and account information

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information.

You are responsible for reviewing your order details before submitting the order. Contact us promptly if you notice an error. We cannot guarantee that an address, size, colour, or product can be changed after an order enters processing.

8. Payment

Payments are processed through Shopify or third-party payment providers.

You authorize the applicable processor to charge the total amount shown at checkout. Your use of a third-party payment service may be governed by that provider’s separate terms and privacy policy.

We are not responsible for delays or losses caused by a payment provider, financial institution, chargeback process, or payment authorization failure beyond our reasonable control.

9. Shipping and delivery

Shipping estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Delivery may be affected by processing time, product availability, carrier delays, customs, weather, labour disruptions, incorrect addresses, peak periods, or other circumstances outside our reasonable control.

Risk of loss and legal title transfer as provided by applicable law and the shipping arrangement used for the order.

You are responsible for providing a complete and accurate delivery address. Additional shipping charges may apply when an order is returned, redirected, or reshipped because of an incorrect or incomplete address.

Our separate Shipping Policy forms part of these Terms.

10. Returns, exchanges, and refunds

Returns, exchanges, cancellations, store credits, and refunds are governed by our Refund Policy in effect when the order is placed.

Nothing in these Terms limits a non-waivable right or remedy available under applicable consumer-protection law.

11. Promotions and discount codes

Promotions and discount codes:

• May be subject to separate conditions

• May expire

• May apply only to eligible products

• May not be combined unless expressly permitted

• Have no cash value

• May be limited to one use per customer or household

• May be cancelled if obtained or used through fraud, misuse, technical error, or unauthorized distribution

Discounts cannot normally be applied retroactively to completed orders unless we expressly agree otherwise.

12. Intellectual property

The Site and its content—including brand names, logos, artwork, graphics, photographs, videos, product designs, written content, page layouts, and promotional materials—are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may use the Site for personal, non-commercial shopping purposes only.

You may not copy, reproduce, modify, distribute, publish, sell, create derivative works from, scrape, or commercially exploit our content without prior written permission.

13. Reviews and user submissions

When you submit a review, photograph, video, comment, testimonial, tag, or other content to us or publicly tag our brand, you confirm that:

• You created the content or have permission to submit it

• The content does not infringe another person’s rights

• The content is not unlawful, deceptive, abusive, or malicious

Where you separately grant us permission to use submitted content, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, display, adapt, and use that content for the agreed promotional or business purposes.

We may remove submissions that violate these Terms.

14. Prohibited conduct

You may not use the Site to:

• Violate a law or another person’s rights

• Commit fraud or submit false information

• Infringe intellectual-property rights

• Harass, threaten, or discriminate

• Upload malicious software

• Collect personal information about others without authorization

• Circumvent Site security

• Scrape or copy the Site through automated means

• Interfere with Site operation

• Place unauthorized or fraudulent orders

• Resell products where we have expressly prohibited resale

15. Third-party services and links

The Site may use or link to third-party platforms, applications, payment services, social networks, and websites.

We do not control third-party services and are not responsible for their content, availability, privacy, security, acts, or omissions. Your use of those services may be subject to separate terms.

16. Errors and omissions

The Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We may correct errors, update information, or cancel affected orders at any time, including after an order is submitted, to the extent permitted by law.

17. Disclaimer of warranties

To the fullest extent permitted by law, the Site and services are provided on an “as available” and “as is” basis.

We do not guarantee that:

• The Site will always be uninterrupted, timely, secure, or error-free

• Product information will always be free from minor inaccuracies

• Every product will meet subjective expectations

• Every defect or technical issue will immediately be corrected

These disclaimers do not exclude warranties, conditions, rights, or remedies that cannot lawfully be excluded.

18. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses, including lost profits, lost revenue, lost data, or loss of opportunity arising from your use of the Site or products.

Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence, or another liability that cannot legally be limited or excluded.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims, liabilities, damages, and reasonable costs resulting from your unlawful use of the Site, infringement of another person’s rights, or material breach of these Terms.

20. Privacy

Our collection and handling of personal information are described in our Privacy Policy.

21. SMS messaging

Our promotional SMS program is governed by our separate SMS Messaging Terms. By subscribing, you agree to those terms.

Consent to promotional SMS messages is not a condition of purchase.

22. Termination

We may suspend or terminate your access to the Site if you materially breach these Terms or use the Site unlawfully.

Sections intended by their nature to survive termination—including intellectual property, disclaimers, liability provisions, and payment obligations—will remain in effect.

23. Severability

If a provision of these Terms is found invalid or unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.

24. No waiver

Our failure to enforce a provision does not waive our right to enforce that provision later.

25. Entire agreement

These Terms and the policies incorporated into them constitute the entire agreement between you and us concerning the Site and replace prior communications concerning the same subject matter.

26. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.

Nothing in this section prevents a consumer from relying on mandatory consumer rights that apply in the consumer’s home jurisdiction.

27. Changes to these Terms

We may update these Terms periodically. The revised Terms will be posted on the Site with an updated effective date.

Your continued use of the Site after an update constitutes acceptance of the revised Terms, except where additional notice or consent is legally required.
